The US Department of Justice asked a federal appeals court on 17 August 2026 to reinstate human smuggling charges against Kilmar Abrego Garcia, after a judge dismissed them in May. The judge ruled the prosecution was selective and vindictive, citing statements by then-Deputy Attorney General Todd Blanche. Abrego Garcia’s defence calls the case politically motivated.
